Eligibility
According to the Americans with Disabilities Act of 1990, “any person with a mental or physical impairment that limits one or more major life activity (may include, walking, seeing, hearing, breathing, working, learning, caring for oneself, or performing manual tasks), has a record of such an impairment, or is regarded as having such an impairment” and presents appropriate documentation is protected under the law. Who is Protected Under the Law?
Any student who is covered under the ADA as amended will not be subject to discrimination under the University’s Policy and as required by applicable law and students with actual disabilities or a record of disability may be entitled to reasonable accommodations.
A “person” with a disability includes “any person who has a physical or mental impairment which substantially limits one or more or such person’s major life activities; has a record of such impairment, or is regarded as having such impairment”. Section 504 protects the civil rights of individuals who are qualified to participate and who have disabilities such as, but not limited to, the following:
- Aspergers
- Blindness
- Cerebral Palsy
- Chronic illnesses, such as:
- Aids
- Arthritis
- Cancer
- Cardiac Diseases
- Diabetes
- Multiple Sclerosis
- Muscular Dystrophy
- Psychological Disabilities
- Deafness or hearing impairments
- Drug or alcohol addiction (Section 504 covers former users and those in recovery programs and not currently using drugs or alcohol)
- Epilepsy or seizure disorders
- Orthopedic impairment
- Specific learning disability
- Speech disorder
- Spinal cord or traumatic brain injury
